Today, as digital transformation permeates every aspect of life, the legal risks and complications grow alongside the opportunities offered by technology and the internet. For individuals and companies, existing in the cyber world also means facing next-generation threats such as data security breaches, cyberattacks, intellectual property theft, and online reputation issues.

At this point, traditional branches of law may fall short in understanding the dynamic and technical nature of the digital world. An IT Lawyer in Ankara is a legal professional who understands not only the law but also the code and workings of technology, operating at the intersection of law and technology. Our goal is to protect our clients' rights in the digital sphere, manage their legal processes, and prepare them today against the risks of tomorrow.

Operating in Ankara, Turkey's regulatory and judicial center, reinforces our command over institutions central to IT law — such as the ICTA (BTK) and TIB — as well as the Supreme Courts and the technopark ecosystem. This strategic position allows us to offer our clients effective and swift legal solutions best suited to both local dynamics and national legislation.

IT Crimes and Criminal Cases

Due to their technical and complex nature, IT crimes require special expertise and meticulous work. Ranging from a social media comment to digital fraud involving millions of lira, these offenses can lead to serious loss of rights for victims and severe prison sentences for suspects. As an IT lawyer in Ankara, we stand by our clients from the very beginning to the end of the process, drawing on our technical knowledge in IT crimes and our criminal law experience. Our goal is to ensure digital evidence is correctly analyzed, to defend the right to a fair trial, and to obtain a legal outcome in your favor.

IT Crimes Under the Turkish Penal Code

Unauthorized Access to an Information System (TPC Art. 243)

  • What Is the Offense of Unauthorized Access to an Information System? This is unlawfully accessing another person's computer system, e-mail account, social media profile, or company network. Even merely entering the system and exiting without performing any action constitutes this offense.

  • Examples: Secretly accessing an ex-partner's Instagram account, gaining unauthorized access to a company's servers, entering a system using someone else's e-Government password.

  • What Is TPC Article 244? This is preventing or slowing down the operation of an information system, or deleting, altering, or rendering data inaccessible.

  • Examples: Blocking access to a website through a DDoS attack, cutting off an account owner's access by entering their account and changing the password, deleting or encrypting important files (ransomware).

  • What is it? Obtaining unjust benefit by using another person's real or fraudulently produced bank/credit card information.

  • Examples: Making online purchases with card information obtained through “phishing,” using a stolen credit card, copying another person's card information.

    • What is it? Manufacturing, selling, purchasing, or possessing a device, software, password, or security code specifically produced for the purpose of committing an IT crime.

    • Examples: Creating malicious software (malware) or a virus, selling password-cracking programs, possessing tools for creating fake websites for phishing attacks.

  • What is it? This is when traditional offenses become “aggravated” by being committed through information systems. Fake e-commerce sites, social engineering methods, and threats to disclose private images (sextortion) fall within this scope.
  • What is it? This is making comments on social media platforms that offend a person's honor, dignity, and reputation, or sharing a person's private images, audio, or correspondence without consent. These acts give rise to serious legal and criminal consequences.

Managing the Investigation and Prosecution Process

In IT crime cases, the outcome depends on taking the right steps at the right time. We guide our clients through this complex process with the following steps:

  • Preparing the Complaint and Criminal Report: For our victim clients, we prepare a strategic criminal complaint petition that explains the incident in full technical detail, includes digital evidence (screenshots, log records, URLs), and prompts the prosecutor's office to take direct action.

  • Accompanying the Client During Police and Prosecutor Statements: We stand by our clients in a suspect position during the statement-taking process to protect their rights, prevent them from making self-incriminating statements under pressure, and ensure legal safeguards from the very beginning of the process.

  • Interrogation Before the Criminal Court of Peace and Objections to Detention: We provide effective defense at the interrogation before the judge — the most critical stage following custody — and prioritize our client's freedom by swiftly filing the necessary objections against detention orders.

  • Collection and Analysis of Digital Evidence: Digital evidence is the most important factor that can change the course of a case. We apply our technical expertise to determining IP addresses, examining log records, analyzing HTS (call detail) records, and auditing whether such evidence was collected lawfully.

IT Law Consultancy for Companies and Individuals

IT law is not limited to combating crime. It also serves as a roadmap for companies operating in the digital world and as a shield protecting the rights of individuals. With a proactive legal approach, it is possible to prevent potential problems before they arise, minimize legal risks, and bring your digital operations into full compliance with the law. As an IT lawyer in Ankara, we provide dedicated consultancy services to companies and individuals, helping them grow safely in the digital sphere and protect their rights.

Personal Data Protection (KVKK) Law

The Personal Data Protection Law (KVKK) imposes serious obligations on all companies and institutions that process personal data. Failure to comply with these obligations can lead to administrative fines reaching into the millions of lira, as well as reputational damage. We ensure your company's full compliance with this complex legislation and manage your risks.

  • End-to-End KVKK Compliance Projects: We analyze your company's data processing procedures, create a data map, and ensure you take all necessary technical and administrative measures to achieve full compliance with the law.

  • Drafting Legal Documents: We prepare all legally required documents tailored to your company, such as the Privacy Notice, Explicit Consent Forms, Cookie Policy, and Data Retention and Destruction Policy.

  • VERBIS Registration Consultancy: We manage the process of fulfilling your registration obligation with the Data Controllers' Registry (VERBIS).

  • Data Breach Management: In the event of a possible data breach, we manage the required legal notifications to the Personal Data Protection Board and the relevant individuals, and provide legal support throughout the crisis process.

E-Commerce Law and Digital Contracts

The sale of goods or services over the internet is subject to numerous legal regulations. Ensuring that every step, from consumer rights to the validity of contracts, complies with the law is critical to the continuity of your commercial success.

  • Legally Compliant Contracts: We prepare documents required for your e-commerce site — such as the Distance Sales Contract, Preliminary Information Form, Membership Agreement, and Privacy Policy — in accordance with current legislation.

  • Consumer Disputes: We represent you in disputes with consumers, such as returns and defective goods, and in Consumer Arbitration Committee proceedings.

  • Influencer and Digital Advertising Law: We draft contracts for your collaborations with social media influencers and ensure your digital advertising campaigns comply with the regulations of the Ministry of Trade and the Advertising Board.

Removing Online Content and Reputation Management

Fake news, an insulting comment, or a photo shared without consent published about you in the digital world can cause lasting damage to your reputation. We bring your digital footprint under control through swift and effective legal intervention.

  • Access Blocking Order: For websites, news articles, videos, or social media posts that violate your personality rights, we obtain an access-blocking order for the content by applying to the Criminal Court of Peace.

  • Removal of Content: Primarily through the “notice-and-takedown” method, we communicate on legal grounds with content and hosting providers to ensure the complete removal of content involving insult, defamation, or copyright infringement.

  • Right to Be Forgotten Applications: We file legal applications under the “right to be forgotten” to prevent outdated, inaccurate, or reputation-damaging results from search engines like Google from being associated with your name.

Intellectual Property Rights in the Digital Environment

Your brand, software, and original content — your company's most valuable assets — are at risk of being copied in the digital environment. We build a legal shield to protect these assets.

  • Copyright Protection: We manage warning notices and litigation processes against the unauthorized copying of articles, photographs, videos, and software code on your website.

  • Trademark and Patent Infringements: We pursue legal action against the counterfeiting of your trademark online, the sale of fake products, or use that constitutes unfair competition.

  • Domain Name Disputes: In cases where domain names containing or similar to your trademark are registered by others (cybersquatting), we initiate legal proceedings to have the domain name transferred to you.

Emerging Areas of Technology Law

Law does not have to lag behind technology. On the contrary, it should serve as a guide that enables innovation while managing its risks. As a firm, we focus not only on today's legal needs but also on the technologies shaping tomorrow's world. In revolutionary fields such as artificial intelligence, blockchain, and crypto assets, we offer our clients a pioneering legal vision, enabling them to move forward confidently and firmly in this new order.

Artificial Intelligence (AI) Law

While artificial intelligence is fundamentally transforming the way we do business, it also raises complex legal questions that need to be answered. Who is responsible for a decision made by an AI algorithm? How is the confidentiality of data processed by AI systems ensured? We provide legal consultancy services in this new and dynamic field.

  • Legal Liability Analysis: We provide strategic consultancy on determining legal liability (manufacturer, developer, user) in situations such as accidents involving autonomous vehicles, AI-based diagnostic errors, or algorithmic discrimination.

  • Data Use and Privacy: We ensure that AI systems process data in compliance with data protection legislation, particularly KVKK, and establish legal frameworks regarding the transparency and accountability of algorithms.

  • AI Ethics and Compliance Consultancy: We provide legal support to companies in establishing and complying with fair, transparent, and human-rights-respecting principles for AI use.

  • Intellectual Property of AI-Generated Content: We guide our clients in light of the current debates regarding the copyright and intellectual property status of designs, texts, or artworks generated by artificial intelligence.

Blockchain Technology and Crypto Asset Law

Decentralized finance (DeFi), NFTs, and cryptocurrencies are redefining the concepts of finance and ownership while also creating legal uncertainties. In this gray area, we offer our expertise to protect our clients' assets and help them operate on legal ground.

  • Legal Status and Taxation of Crypto Assets: We provide up-to-date and comprehensive consultancy on the legal classification of cryptocurrencies, NFTs, and other tokens, as well as the taxation of gains arising from their purchase, sale, and transfer.

  • Exchange and Platform Consultancy: We provide legal support to cryptocurrency exchanges and Web3 platforms on drafting user agreements, complying with obligations under MASAK (the Financial Crimes Investigation Board), and anti-money laundering (AML) procedures.

  • Smart Contracts: We provide guidance on the legal validity of smart contracts operating on the blockchain and executing transactions without intermediaries, their binding nature for the parties, and the resolution of potential disputes.

  • Token Offering Processes (ICO/STO/IEO): We ensure that token offering processes carried out by projects to raise funds are conducted lawfully within the framework of the Capital Markets Board (CMB) and other relevant legislation.

Frequently Asked Questions

How Much Do Consultancy and Representation Fees Cost for an IT Lawyer in Ankara?

Attorney's fees vary depending on the nature of the case or consultancy service. The Minimum Attorney's Fee Tariff, published annually by the Union of Turkish Bar Associations, sets the minimum fee that may be charged. However, the final fee is determined based on factors such as;

  • The complexity of the case and the effort it requires,

  • Whether it is at the investigation or prosecution stage,

  • Whether technical analysis or an expert report is required

For this reason, the most reliable way to get accurate fee information is to request a preliminary consultation in which we can assess your situation. We are happy to offer you transparent, tailored pricing.

My Social Media Account Was Hacked, What Should I Do?

If you have been insulted on social media, here are the steps you should take:

  1. Collect Evidence Immediately: Be sure to take screenshots that clearly show the insulting comment, message, and the profile that made the post. Also copy and save the link (URL) where the post was made.

  2. Initiate the Legal Process: You have two fundamental rights.

    • Criminal Investigation: To have the person who insulted you punished, you can file a criminal complaint with your nearest prosecutor's office or the cybercrime police, along with the evidence you have collected.

    • Non-Material Damages Case: You can file a compensation case in the civil courts for the non-material harm you have suffered.

Getting support from an IT lawyer to ensure these processes are carried out correctly and completely, that the evidence is presented lawfully, and that the perpetrator is identified (even if using a fake profile), will prevent the loss of your rights.

Can I Have a Website Completely Shut Down?

The process commonly known as “shutting down a site” is legally referred to as “blocking of access.” Under Law No. 5651, access to an entire website or to specific content (a URL) on that site can be blocked by a decision of the Criminal Court of Peace in situations such as:

  • Violation of your personality rights (defamation, fake news, insult),

  • Violation of your right to privacy (unauthorized sharing of photos, videos, or information),

  • An offense being openly committed on the site.

Accordingly, rather than the entire site, access is generally blocked only to the link of the specific page containing the unlawful content. However, if the entire site consists of content constituting a crime, a blocking order can also be requested for the entire site.

How Much Is the Fine in the Event of a KVKK Violation?

The Personal Data Protection Board (KVKK) has the authority to impose serious administrative fines on data controller companies or institutions that act contrary to the law. The amount of the fine varies according to;

  • The nature of the violation,

  • The number of people affected by the violation,

  • The size of the company and whether there was intent.

Under current regulations, fines can range from tens of thousands of lira for violations such as failure to fulfill the disclosure obligation, up to millions of lira for more serious violations, such as breaches of data security obligations. For this reason, the KVKK compliance process should be viewed not merely as a way to avoid a potential fine, but as a necessity and a sound investment.
